Outcome Variability

Due to the nature of aviation materials, aircraft age, environmental exposure, prior maintenance history, and manufacturer limitations, SMG does not guarantee any specific cosmetic, aesthetic, or performance outcome. Results may vary depending on aircraft condition and material limitations, and certain staining, oxidation, corrosion, wear, or defects may be permanent. By engaging SMG, the client acknowledges and accepts these inherent limitations.

Client Responsibilities

Clients agree to provide accurate aircraft, ownership, and access information; confirm they have legal authority to approve requested services; disclose any known damage, defects, sensitivities, or special handling requirements; secure all required airport, FBO, operator, or third-party permissions; and remove or safeguard personal valuables prior to service. SMG is not responsible for undisclosed conditions, inaccessible areas, or pre-existing damage.

Limitation of Liability

To the maximum extent permitted by law, Sterling Mobility Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, operational delays, or business interruption. SMG is not responsible for cosmetic imperfections inherent to aviation materials, pre-existing damage or wear, or the acts or omissions of third parties, including FBOs, airport staff, vendors, or suppliers. Any liability, if established, shall be strictly limited to the amount paid for the specific service giving rise to the claim.

Aviation Risk Acknowledgment

The client acknowledges that aviation environments involve inherent risks, including but not limited to weather exposure, tight operating spaces, sensitive avionics and materials, and aircraft surface fragility. By engaging SMG, the client expressly assumes all risks associated with aircraft servicing, except in cases of proven gross negligence by SMG where prohibited by law.

Third-Party & Outsourced Services

Certain services, including but not limited to brightwork, coatings, refurbishments, or specialty treatments, may be performed by vetted third-party contractors. SMG is not responsible for the acts, omissions, performance, or failures of third-party vendors. Any warranties or guarantees provided are solely those of the third party, and SMG acts only as a coordinator unless otherwise expressly stated in writing.

Provisioning & Alcohol

Cabin provisioning services are provided solely as a convenience. SMG does not manufacture, certify, or guarantee consumable products. Alcohol services are provided only to legally authorized parties. The client assumes full responsibility for alcohol compliance, storage, handling, and consumption. SMG shall not be liable for allergic reactions, spoilage, misuse, or regulatory violations related to consumables.

Membership Programs

Membership services are subject to defined service limits per membership tier, scheduling availability, and non-transferability unless approved in writing. Memberships may be modified or cancelled upon written notice in accordance with membership terms. SMG reserves the right to modify membership offerings, pricing, or inclusions with reasonable notice.

Scheduling, Delays & Cancellations

All service times and completion estimates are approximations and not guarantees. Delays may occur due to weather, aircraft condition, airport operations, safety concerns, or regulatory requirements. Cancellations or rescheduling may incur fees depending on notice provided. Emergency or safety-related cancellations are exempt.

Payment Terms

Payment is due upon invoicing unless otherwise agreed in writing. Late payments may result in additional fees or suspension of services. Membership fees are billed according to the agreed schedule. All prices are subject to change without prior notice.

Indemnification

The client agrees to indemnify, defend, and hold harmless Sterling Mobility Group, its members, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, or expenses arising from client negligence, misrepresentation, unauthorized aircraft access, regulatory violations, or third-party disputes.

Intellectual Property

All content on this website, including logos, branding, text, images, and materials, is the exclusive intellectual property of Sterling Mobility Group and may not be copied, reproduced, or used without prior written permission.

Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located within California.

No Waiver

Failure by SMG to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

Sterling Mobility Group reserves the right to update or modify these Terms at any time. Continued use of the website or services constitutes acceptance of the revised Terms.
